I think it is untenable in part because of the word "hardly". Which I
believe means it "does on occasion occur". So the question remains. Why?
Why, as a matter of law, institutionalize the premise that society
values more highly the life of a convicted murderer, than the life[s] of
the current and future victim[s]? I know.... I know.... Pirsig supports
this, because the potential "ideas" of a murderer are of the same level
as "ideas", intellect, in general. And because the intellect is the most
valuable level, ideas must be preserved at all cost. Unfortuately, in
many cases these COSTS are seldom if ever equal to the REAL value preserved.
Without life ( inorganic/biological value), one cannot have liberty
(social value) or ideas (intellectural value). Under this perversion of
the law if I take your life (biological value) thus ending your (social
value) and (intellectual value) society in reality rewards me by
restricting only some of my (social values), some of my liberties. I
still have life (inorganic/biological value) some liberty (social
values) and any ideas (intellectual values) I'm capable of fathoming. In
the mean time all of society is lessened by the values, on all levels,
they contribute to support me, while both society and the victims have
been robbed of all but the victims (inorganic values) which I hear makes
good tulip fertilizer. This is a moral system? Only if you are a major
marketer of tulips ;-<
